On September 17, 2007, 75-year old Duncan MacGillivray was trying to exit a pier-located car park. Little did he know that it would cost him his life. As he accidentally put the car in forward gear instead of reverse, the car tipped off the exposed edge of the car park and plunged into the sea below. Trapped inside his car, Mr. MacGillvray eventually drowned.

Following this tragic accident, Agryll and Bute Council pleaded guilty to violating Section 3(1) of the Health and Safety at Work Act 1974 and was fined £20,000 by the Dunoon Sheriff Court.

The Court heard that no risk assessment had been conducted prior to the pier being used as car park nor after the council began to operate it as one. The council had also neglected to install sufficient edge protection to avert accidents such as this one. The HSE launched an investigation into the incident and found that there were only a few barriers at the pier and the area where the victim had parked did not have any. A proper barrier would have prevented Mr. MacGillivray from plunging three feet into the waters below and meeting his death.

HSE Inspector Mike Orr commented that the circumstances under which Mr. MacGillivray died were traumatic and it was a tragic case of drowning. He added that a simple and timely risk assessment by the council would have revealed the dangers that the unprotected car park posed to those parking their car on the pier car park but the council had sadly failed to carry out its duty.
